Pakistan confident ICJ will reject India's claim for Jadhav's 'acquittal or release'

The Indian High Commissioner too will be allowed to meet Jadhav. On May 18, the ICJ through an interim order had stayed Jadhav's execution after which the Foreign Office communicated to the ICJ that the government of Pakistan had instructed its all relevant departments to give effect to the order of the world court.

The reply, submitted by Pakistan foreign office's director (India) Fariha Bugti, also claimed that Jadhav case did not fall under the purview of the Vienna Convention.

Claiming that Jadhav is not an ordinary person as he entered the country with the intent of spying, Pakistan in its reply to ICJ said, "Only a state which adheres to legitimate actions can request the court to intervene in a matter between two states".

India has appealed to the court to impose emergency measures for Jadhav's execution to be suspended until the legal battle in Hague concludes, while also accusing Pakistan of violating the Vienna Convention by failing to provide him with consular access and for being in breach of global human rights law.

The reply encompasses the charge-sheet against Jadhav and narrates Pakistan's stance in a comprehensive manner.

The ICJ had set December 13 as the deadline for Pakistan to submit its counter-pleadings in the case.

Commander Jadhav was captured in Balochistan in March 2016 and he later confessed to his association with Indian intelligence agency Research and Analysis Wing (RAW) and his involvement in espionage and fomenting terrorism in Pakistan.

India has repeatedly sought consular access to Jadhav which has been denied by Pakistan.

His video confession was released by Pakistan in which he stated that he was tasked by RAW to plan, coordinate and organise espionage, terrorist and sabotage activities aimed at destabilising and waging war against Pakistan. The Pakistani authorities also allowed the presence of an Indian High Commission official at the meeting as requested by New Delhi during the meeting.

Jadhav was sentenced to death by a Field General Court Martial (FGCM) in Pakistan this year in April.

Army Chief General Qamar Javed Bajwa ratified the sentencing by the army tribunal.

The spokesperson, responding to a query regarding China halting payments on three projects of the China-Pakistan Economic Corridor (CPEC), said payments were made through a mechanism and details are with the relevant ministries.
